Can I make an accident abroad claim?

Going abroad doesn’t reduce your chances of suffering from an accident. You can come across negligence wherever you go. This means you may end up suffering from the same kind of personal injury abroad as you could here in the UK.

Can I make a claim for a package holiday accident?

Is there a time limit to make an accident abroad claim?

In the majority of accident abroad cases, you’ll have three years in which to make your claim. Although this can sound like a long time, it’s always a good idea to start your claim as soon as possible.

The sooner you start your claim, the more straightforward it will be to access any evidence you may need. The details of what happened will also be clearer in your mind if you begin your claim as soon as possible.

What evidence do I need to make an accident abroad claim?

If you’ve had an accident abroad, to make a claim you’ll need to present strong evidence. This can include:

  • Accident book records

Make sure that if you are injured or fall ill in a hotel, you report it to the hotel’s staff. Get them to record the incident in their accident book and make sure they do it. Get a copy of the report for yourself, if possible.

  • CCTV

If your accident happened in public, you may be able to access CCTV footage of it. The earlier you request this footage, the higher your chance of getting it. If you’re able, you could request it immediately after your accident, before you leave the scene.

  • Photographs and video

Photographs and video of the accident scene and your injuries can form compelling evidence in an accident abroad claim. As soon as you’re able to, take the appropriate photos of the scene and your injuries – or get someone else to do it if you’re unable.

  • Witness statements

Make sure you get the details of any witnesses to your accident – including names, contact details and addresses. They could help to strengthen your case by providing a statement detailing what they saw happen.

  • Symptom diary

You could also list the symptoms you’ve experienced since suffering your injury and how they have affected your daily life. Explain how the severity of your injury has changed and how it has made certain aspects of your life difficult – from going to work to participating in your favourite hobbies.

Can I make a claim for a holiday accident in the UK?
