What is cauda equina syndrome?

Cauda equina syndrome is a serious spinal condition which develops when the nerves at the bottom of the spine are compressed.

Decompression surgery is the most effective treatment for cauda equina syndrome. And it should be carried out as early as possible to prevent the condition from worsening. But sadly, this doesn’t always happen.

If your symptoms weren’t treated quickly enough, or they were ignored altogether by medical professionals, you could have grounds to make a cauda equina compensation claim. This might apply if:

  • You were misdiagnosed or diagnosed too late
  • You didn’t receive adequate treatment after being diagnosed
  • There were errors during your surgery

To make a cauda equina claim, you’ll need to be able to prove that you received substandard medical care and that this directly led to your condition getting worse. This can seem like a daunting prospect, but our cauda equina solicitors are here to support you.

Get in touch with our friendly team today to find out if you could have a case for compensation.

What can happen if cauda equina goes untreated?

Cauda equina syndrome should be treated as a medical emergency. This is because if it is not treated early enough, the consequences could be life-altering.

Some of the most common conditions resulting from untreated cauda equina syndrome include:

  • Irreversible bladder and bowel issues
  • Loss of feeling in the legs and feet
  • Mobility problems
  • Neurological damage
  • Severe pain
  • Sexual dysfunction

Most people with cauda equina syndrome will make a full recovery after undergoing decompression surgery, as long as the procedure is carried out quickly.

But in many cases, diagnosis and treatment isn’t received fast enough. In these circumstances, you could be entitled to make a claim.

Why should I make a cauda equina claim?

Any form of medical negligence is devastating. If your condition has worsened as a result of a delayed diagnosis or substandard treatment, it’s only right that you seek compensation and support.

You may find that you’re unable to spend as much time with family and friends due to the negligence you suffered, or perhaps you’ve been unable to return to work. This can add another layer of emotional and financial distress, on top of the physical pain you’re dealing with.

Making a claim won’t undo what happened. But if your case is successful, the compensation you receive could help you to make any necessary adjustments – such as home or vehicle adaptations – without the worry of the costs involved.

By taking legal action, you’ll also be highlighting the failings in your care. This could prompt an investigation, meaning changes will be made and the same mistakes won’t be repeated.

We understand that the thought of making a claim can feel overwhelming. But your solicitor will be at your side throughout, so you won’t be going through the process alone.

How can First4Lawyers help?

We work with experienced cauda equina lawyers who will help to take some of the stress out of your claim. They’ll gather evidence to support your case, giving it the strongest possible chance of success.

If the medical organisation responsible for the negligence you suffered admits responsibility, your solicitor may even be able to apply for interim payments. These will be paid out to you before your case is settled, so you can cover any immediate costs.

For these types of claims, we work on a No Win No Fee basis. This means there will be nothing to pay upfront and no legal fees to cover if your case is unsuccessful.

Only pay a fee if you receive compensation

Our No Win No Fee solicitors will take a success fee from the compensation you are awarded for a successful claim in the form of a percentage of your damages. This could be up to 25% but it won't be more than that, except in cases of road traffic accidents. Changing laws mean our solicitors will now take a payment of 35% of the final compensation amount plus VAT for all road traffic accidents.

First4Lawyers are an award-winning claims management company with a track record of delivering service that our clients love.

At First4Lawyers, our priority is to provide a supportive and compassionate approach, as highlighted here by Jacqueline Busby, our Head of Legal Services:

“When a claim is of a sensitive nature, like those involving cauda equina syndrome, our team take extra care to make people feel as comfortable as possible. We know it can be difficult to go through the details of what happened again, so we aim to offer reassurance and compassion.

“Taking action against those who have hurt you is a brave step. That’s why we do our utmost to minimise the stress involved in a cauda equina compensation claim.”

Cauda equina claim FAQs

How much compensation could I claim for cauda equina negligence?

The amount of compensation you receive for your cauda equina syndrome claim will depend on your individual situation. But if your case is successful, your compensation will most likely be split into two categories: general damages and special damages.

General damages will account for the pain and suffering you’ve endured as a result the negligence you experienced. To get an idea of how much you could be owed in general damages, try our free compensation calculator.

Special damages are slightly different as they will consider any financial losses related to your claim. This might include the cost of further treatment, travel to and from hospital appointments, or any loss in earnings if you’ve had to take time off work.

Your solicitor will be able to provide a more accurate estimate of how much your claim could be worth after discussing the details of your case with you.

Is there a time limit on when I can make a cauda equina claim?

You’ll usually have three years to make a claim for cauda equina negligence.

While this may seem like a long time, we would suggest speaking to a legal expert sooner rather than later. Not only will this mean that the details of what happened will be fresh in your mind, but it could also help your solicitor access evidence including medical records.
