What is a spinal injury claim?

Suffering a spinal injury can be life-changing. In the UK, it’s estimated that spinal cord injury paralyses someone new every four hours. This comes from data collected by Aspire, the Spinal Injuries Association and Back Up – three leading spinal injury charities.

If you’ve suffered a spinal cord injury and it was someone else’s fault, you could have grounds to make a spinal injury claim.

Common examples of negligence leading to spinal injuries include:

However you’ve sustained your spinal injury, we could help you claim the compensation you deserve. Get in touch with our friendly claims advisors for a free initial consultation to find out more.

How spinal injury compensation could help you

We understand the financial worries that suffering spinal damage can bring. You may need ongoing care as a result of your injuries, and it’s not unusual to have concerns about how you’ll pay for this.

But making a claim for compensation could help to bring you some reassurance. If your claim is successful, your settlement will take into account expenses such as:

  • Adaptations to your home or vehicles
  • Further rehabilitation
  • Post-injury care
  • Specialist mobility aids
  • Transport to and from hospital appointments

If the individual or organisation responsible for your spinal injury admits liability, your solicitor may even be able to apply for what’s called an interim payment.

This payment is taken from your final compensation amount and you will receive it before the case is settled. So you’ll have the confidence of knowing any immediate expenses can be paid for.

We know that making a claim isn’t just about the compensation, though. Our spinal injury solicitors will work to ensure you get recognition for the pain and suffering you’ve endured. So you can move forward with a sense of closure .

In certain cases, your solicitor may also be able to arrange for you to see a rehabilitation specialist or help you access further treatment to support your recovery. Your wellbeing is the most important thing, so this will always be at the forefront during the claims process.

How can First4Lawyers help?

Putting a claim together can be a daunting prospect, and we understand that. We’re here to listen to your situation, advise you of your options and guide you through the process of making a spinal injury claim.

Our expert personal injury solicitors are experienced in handling claims involving spinal injuries. They will work on your behalf to secure you the compensation and support you deserve. So you don’t need to worry about going through it alone.

For these types of claims, we offer a No Win No Fee service. This means you won’t have anything to pay upfront and there will be no legal fees to cover if your claim is unsuccessful.

Only pay a fee if you receive compensation

Our No Win No Fee solicitors will take a success fee from the compensation you are awarded for a successful claim in the form of a percentage of your damages. This could be up to 25% but it won't be more than that, except in cases of road traffic accidents. Changing laws mean our solicitors will now take a payment of 35% of the final compensation amount plus VAT for all road traffic accident claims.

First4Lawyers are an award-winning claims management company with a track record of delivering service that our clients love.

Spinal injury claim FAQs

How much compensation can you get for a spinal injury?

Every claim is unique, so it’s difficult to say exactly how much compensation you could receive without knowing the details of your case. But most spinal injury compensation payouts will be split into two categories. These are known as general damages and special damages.

General damages will consider the pain and suffering caused by your injuries, both physical and emotional. For a general idea of how much your claim could be worth in general damages, try our free compensation calculator.

Special damages are slightly different as they will cover any financial losses related to your injuries. This could range from lost earnings if you’ve been unable to work, to the cost of medication.

Is there a time limit on spinal injury claims?

Most spinal injury claims will need to be made within three years. This may sound like a long time but we would always suggest seeking legal action sooner rather than later.

By starting your claim early, you’ll have the comfort of knowing all the relevant deadlines will be met. It may also be easier for your solicitor to access key evidence such as CCTV, witness testimonies or medical records.

If you’re thinking of making a claim on behalf of a child, you will have until their 18th birthday to do this. After that, they will have until their 21st birthday to decide whether to take legal action.

And if you’re claiming for someone who is lacking mental capacity, there won’t be any time limits applied to your case.

You can read more about the time restrictions surrounding these types of claims in our free personal injury time limits guide.

I’ve suffered a spinal injury – what should I do?
