What is covered by a personal injury claim payout?
A personal injury claim payout is broken down into two parts: general damages and special damages. These cover different things and go towards ensuring that you are fairly compensated for an accident that wasn’t your fault.
General damages typically fall into a set range of compensation you can receive. They cover the pain and suffering you have experienced as a result of your injury. The compensation range you might be entitled to is set out in the Judicial College’s Guidelines for the Assessment of General Damages in Personal Injury Cases.
These damages are intended to compensate you for your injury and its direct impact on your life. This includes physical pain or impairment, mental pain and a reduced quality of life. These effects on your life can’t be mathematically calculated, unlike special damages, which is why the range of compensation exists.
Special damages compensate for any way you have been left worse off financially because of your accident. This will depend on your specific circumstances but can include medical expenses, damaged personal property and a loss of earnings – both current and future if your injury has long-term consequences.
It is a good idea to keep hold of the receipts for anything you spend money on relating to your injury. This includes parking for medical appointments, travel to and from those appointments and anything you need to help your recovery, such as wheelchairs or any home modifications. This helps to make it more straightforward to be reimbursed when you make your personal injury claim.
How much will I receive after a personal injury?

The severity of your injury and how long your recovery is expected to take will all have an impact on the compensation you could receive. What may be an average payout for a moderate injury to your little finger will not match an average payout for a severe brain injury.
As general damages have to be assessed during the course of a personal injury claim, it is not always certain that you will receive the amounts set out by the Judicial College’s guidelines. You could receive more or less. It all depends on the severity of your injury and how much of an impact it’s going to have on your life.
