Who is Considered a Vulnerable Road User?
Who are the most vulnerable road users?
Everyone has the right to feel safe on the roads, but some road users are inherently more vulnerable than others. In 2022, the Highway Code was updated to reflect this fact, and those who are the most at risk have now been placed at the top of a new ‘hierarchy of road users’.
This doesn’t take away from the fact that all road users should behave safely. But it does put a greater responsibility on those driving vehicles that could cause more harm to ‘reduce the danger they pose to others’.
According to the Highway Code, road users requiring extra care include:
In 2021, these groups accounted for half of fatal road accidents reported in Great Britain, representing the highest casualty rate. One of the main reasons for this is the relative lack of protection these road users have compared to people driving vehicles like cars or vans.
Because cyclists, motorcyclists and pedestrians are so exposed, the results of a collision can be devastating. If you or a loved one has been injured as a vulnerable road user, you could be entitled to compensation.
Can I make a claim as a vulnerable road user?
If you or someone close to you was involved in a road accident – either as a cyclist, motorcyclist or pedestrian – and it was someone else’s fault, you could have grounds to make a road traffic accident claim.
Suffering any kind of road collision is always a traumatic experience. But if you were classed as a vulnerable road user at the time of the accident, your injuries may be more severe.
Claiming compensation won’t reverse what happened, but it could help you to cover the costs associated with your recovery such as further medical treatment or mobility aids. It may also provide a sense of closure for you as the person responsible is held to account.
We know that you may initially be in shock following your accident. But we would encourage you to try to gather as much information as you can after getting the medical attention you need.
Details such as the other person’s name and contact information, the make of their vehicle, and any photos or videos of the scene could be invaluable if you decide to start a claim. An experienced solicitor will help you to collate these details as well as any other evidence to build a strong case.
How much compensation could I receive?
As with any successful personal injury claim, how much compensation you receive will be specific to your case. But to work out the value of your claim, your solicitor will consider:
- How severe your injuries are
- How your injury is impacting your daily life
- The circumstances surrounding your accident
- The level of care you’re likely to need in future
These are just a few points that will be taken into account during the negotiations for your compensation. But your solicitor will ensure that the final settlement you receive is reflective of what you’ve been through. So you can feel confident that you’re getting the best outcome possible.
